It’s no secret; Short Sales are a fundamental part of today’s real estate market. When over 1 out of every 10 homeowners is facing foreclosure it’s virtually impossible to ignore them and still stay in business. Let’s face it, short sales can be extremely time consuming, ever-evolving and worst of all the process can be uncertain. It can be tough to juggle the responsibility of running your real estate business and actively negotiate short sales. Many agents have chosen to outsource their short sale negotiation, but this option can be costly and cut into your commissions.


In a recent DRE bulletin titled “Warning Regarding Residential “short” sales.” The Department of Real Estate warns about short sale “flipping”, paying unlicensed negotiators and gives parameters to agents when the buyers chose to pay the short sale negotiation fee. We’ve broken the bulletin down into 6 elements to help you structure it the right way.


Element 1

The negotiator must be a California Real Estate Broker or salesperson affiliated with a broker. All of their licenses must be current.

We are licensed with the California Department of Real Estate under license # 01883210. All officers, contractors and employees who negotiate any transactions are licensed and certified to process short sales.

Element 2

An Agency Disclosure must be signed by the buyers(s) and the short sale negotiator.

Every transaction in which Short Sale Experts negotiates and is compensated by the buyer, an Agency disclosure is completed and signed by all parties.

Element 3

A contract must exist between the short sale negotiator and the buyer that includes the legal verbiage that “…commissions are not fixed by law…”

Short sale Experts, Inc. utilizes a buyer discount fee agreement that outlines the responsibilities of our organization to process as a service provider to the seller and buyer and includes legal verbiage that “…commissions are not fixed by law.”

Element 4

Disclosure and confirmation of Real Estate Agency Relationships.

Short Sale Experts, Inc. utilizes C.A.R. form AC, (Revised 04/08) as required by the California Civil code to confirm its agency relationships.

Element 5

The decision to utilize a negotiator must be a condition of the seller and must be expressed in writing.

It is important that the seller understands the relationship of the negotiator and the Listing agent to efficiently discount the payoff to approve the short sale and ultimately sell the home. We require written confirmation that the seller understands that requiring the buyer to pay the short sale negotiation fee can limit the exposure of the home to available buyers who would prefer not to pay the fee.

Element 6

The short sale negotiation fee must be disclosed on the HUD and presented to both buyers and seller’s lenders.

We ensure that each lender has agreed to the buyer paying our fee and has given us written approval of the final settlement statement.
